Operation Python Dance II has led a group to sue President Buhari and the Nigerian Army. Joined in the Suit is the Chief of Army Staff, Gen Tukur Burutai.
A pan Igbo, the Alaigbo Development Forum (ADF) dragged President Buhari, the Chief of Army Staff, Gen Tukur Yusuf Burutai and the Nigerian Army before the courts over the recent military exercise in the South-East of Nigeria, Operation Python Dance II.
The ADF wants the Federal High Court sitting in Enugu to order the military and operation Python Dance out of the South-East. In the suit which was filed on Thursday, September 14, 2017, the ADF are seeking;
“A declaration that the action of the Defendants, especially the 1st Defendant (Buhari), in calling out, operationally engaging or deploying the armed forces of the Federation to the south eastern part of the country is illegal, unconstitutional, null and void and of no effect whatsoever.”
The suit instituted via Originating Summons by the ADF led by Prof. Uzodinma Nwala has an affidavit sworn to by Amaechi Ezeh stating reasons why the action is compelling.
He stated in affidavit that: ‘I know for a fact that there is no state of emergency in the South Eastern part of Nigeria comprising Abia, Anambra, Ebonyi, Enugu and lmo states.
“I also know that there is no war situation in the South Eastern states of Nigeria which constitute the Area of Responsibility of the 82 Division of the Nigerian Army comprising Abia, Anambra, Ebonyi, Enugu and lmo States.
As a matter of fact, “there is no external aggresion, threat to territorial integrity, violation of the borders of Nigeria, or insurrection in the South Eastern part of Federal Republic of Nigeria to warrant the deployment of the Armed Forces of the Federation,” the Ezeh added.
The Plaintiffs are also seeking that an order restraining the defendants, especially the 1st defendant, from deploying and or further deploying or operationally engaging the armed forces of the Federation of Nigeria to the South Eastern part of the country in furtherance of Operation Egwu Eke ll (Operation Python Dance).
While it is commendable that the ADF has resorted to taking their grievances over the Military action in the South East to the Courts, it would also be good for the group to speak out against those in the South East who choose to attack the integrity of the Nigerian Nation. Also, the Nigerian Army should understand the sensitive nature of their operations in the South East and be careful not to go overboard in rooting out elements of disunity and discord, Human right violations should not be tolerated in this exercise.
